All bookings with Steve Beeston Photography are subject to the terms and conditions below. By requesting services provided by Steve Beeston Photography, it is understood that you have read and accepted these terms and conditions. In the clauses set out below, the terms "Steve Beeston Photography" and "the Photographer" are interchangeable.

In accordance with the Copyright, Designs & Patents Act 1988, the copyright of all images created by the Photographer is owned by the Photographer.
Any images or copies of images whether stored digitally or printed remain the property of the Photographer and are protected by the Act. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of a contract without the permission of the Photographer in writing. Any breaking of seals or downloading of images electronically will presume a breach of copyright.
Licenses are granted for the use and or display of images produced by Steve Beeston Photography. Said images may not be altered or used in any manner outside what is prescribed in these terms and conditions without prior written permission of Steve Beeston Photography. The Client must obtain written permission from and compensate Steve Beeston Photography prior to the Client, their associates, friends or relatives re-distributing or selling the photographs.
Payment for services provided by Steve Beeston Photography may be made in cash, by cheque, bank transfer or Paypal within 30 days of the date of invoice.
Once the Client has made a booking for a specific time and date, Steve Beeston Photography will not accept any other work from other clients for those times and dates. For outdoor work, in the event of bad weather on the day of a shoot, the Photographer will provide a list of available dates for the client to choose from. Should the client not wish to accept one of these dates, the agreement will be cancelled and any monies paid will be retained by the Photographer. If the Photographer has to cancel an arrangement for reasons beyond their control, for example including but not limited to death, injury or sickness, the Photographer's liability shall be limited to a full refund of any monies paid.
All prices quoted to the Client apply only to the original job description and specifications given to the Photographer by the Client. The Photographer reserves the right to make additional charges for fees and expenses should these descriptions or specifications differ or change before or during the assignment. Wherever possible, the Photographer shall endeavour to provide an indication of what these additional charges will be.
Travel expenses are included within a catchment area of 20 miles from Hertford with the exception of travel to and within London. Additional mileage is charged at £0.45 per mile.
In the unlikely event that the Photographer is unable to complete the agreed coverage due to severe medical, natural or other unforeseen circumstances, responsibility and liability of the Photographer is limited to the return of any payments received from the client.
The Photographer agrees that every effort will be made to provide high quality photographic services. In the unlikely event that a catastrophic mechanical failure should occur to the Photographer's equipment or that the Photographer is unable to provide the client with the agreed upon photography services, it is agreed that the Photographer is not responsible for any consequential damages, emotional or otherwise and that the photographer's liability shall be limited to a full refund of any monies paid.
In the unlikely event that the photographer is injured or becomes too ill, or has an extreme emergency that prevents them from fulfilling their role, Steve Beeston Photography will make every effort to reschedule the work. If for whatever reason this is not possible, responsibility and liability is limited to the rescheduling of the services requested. Steve Beeston Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Steve Beeston Photography's control, Steve Beeston Photography's liability is limited to the return of any payments received for the agreed services.
The Photographer shall not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit. Where work is defective for any reason, including negligence, the photographer's liability (if any) shall be limited to rectifying such defect.
Personal Accident Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
The client understands and accepts that the photographic coverage will be as the Photographer's professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made on behalf of the Photographer to comply with the client's wishes. Any special requests must be made in writing. Although every possible care will be taken, the Photographer does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement due to changes of the weather, time restraints and the availability and willingness of subjects.
The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye. All images will be adjusted for exposure, brightness, contrast, sharpness, etc. The Photographer's judgement regarding these corrections and the number of images given to the client for preview shall be deemed correct. The Photographer does not accept any responsibility for negativity regarding a person's opinion on their appearance in any images taken. Additional basic retouching is available to the client as an option at extra cost.
The client acknowledges that they are familiar with the Photographer's portfolio and are requesting service with knowledge of the Photographer's style. It is understood and accepted that the Photographer's work is constantly evolving and that the Photographer will use their personal artistic judgement to create images of the event, which may be different from the client's vision. It is also acknowledged that the photographs shall not be subject to rejection by the client on basis of taste or aesthetic criteria.
The client will receive an edited selection of high-resolution JPEG digital images, chosen by the Photographer on judgement of image quality. The Photographer retains all rights to the images not given to the client and is not required to present these to the client under any circumstances.
Final images are typically delivered within 14 days. An expedited service can be provided at additional cost where other commitments allow.
Delivery can be made on DVD or USB memory stick, via my own online cloud service, or email for small numbers of medium-resolution images (typically 2-6MP resolution).
Where agreed, the final edited images will be made available in a password-protected online gallery and available to view for a maximum of 6 months. Any orders for prints must be placed within this time.
The Photographer must be notified of any complaint in writing (email is accepted) within 5 working days of the client being in receipt of the final images/order, setting out the nature and reason for complaint. The Photographer aims to resolve the complaint in a timely and understanding manner.
Steve Beeston Photography reserves the right to amend these Terms and Conditions without prior notice.
